Shipshe Trailers & Fab Limited Warranty

Shipshe Trailers Limited Warranty:

MIG LLC, and Indiana limited liability company doing business as Shipshe Trailers& Fab (“Shipshe Trailers”) here by warrants to the original purchaser (“you” or “your”) that the Shipshe Trailer or manufactured component (each, the “Product”), operated under normal use, will be free from material defects in materials and workmanship for one year, subject to the requirements, exclusions and other limitations stated below (the “Limited Warranty”). The one-year term of this Limited Warranty is measured from the date commencing five business days after you are notified that the Product is finished and ready for pick up. THIS LIMITED WARRANTY IS NOT TRANSFERABLE TO SUBSEQUENT OWNERS.

Limitations:

This Limited Warranty only covers the structural items, namely the frame, welds, and components manufactured by Shipshe Trailers. Without limiting the generality of the foregoing, this Limited Warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow Product instructions or to perform any preventative maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; or (h) external causes such as accidents, abuse, or other actions or events beyond Shipshe Trailer’s reasonable control. Shipshe Trailer’s determination of whether the Product has been abused or misused is final and binding on you regarding your rights under this Limited Warranty.

Pre-Authorization Requirement:

All repairs or services performed on a Product must be pre-approved by Shipshe Trailers before any expenses will be covered under this Limited Warranty. Shipshe Trailers will not be responsible for work performed by a third party, unless Shipshe Trailers gives its prior written authorization for such work to be performed. THIS LIMITED WARRANTY WILL BE VOIDED BY ANY REPAIR OR MODIFICATION TO THE PRODUCT, OR ADDITION OF ACCESSORIES TO THE PRODUCT, BY ANYONE OTHER THAN SHIPSHE TRAILERS OR SUCH OTHER THIRD PARTY AS SHIPSHE TRAILERS, IN ITS SOLE AND ABSOLUTE DISCRETION, MAY APPROVE.

Shipshe Trailer’s Obligation:

Shipshe Trailer’s sole obligation under this Limited Warranty and your sole remedy is for Shipshe Trailers to repair all defects in materials and workmanship covered by this Limited Warranty. Shipshe Trailers will not be obligated, in any way, to replace the Product or to refund the purchase price of the Product covered by the Limited Warranty unless Shipshe Trailers determines, in its sole and absolute judgment, that the Product cannot be repaired. In addition, Shipshe Trailers shall not be obligated to pay for any repairs made to the Product by or on behalf of you without express prior written approval by Shipshe Trailers. Shipshe Trailers will attempt to remedy all defects covered by the Limited Warranty within a reasonable time.

Owner Responsibilities:

1. Check the torque on all lug nuts before using a trailer. Re-check after 100 Miles. Loose lug nuts cause the holes in the rim to elongate & the studs to sheer off.  Shipshe Trailer is not responsible for loss or damage due to improperly torqued wheels.
2. Check the tire pressure on all tires before every trip and inflate them to the maximum cold tire pressure requirements found on the sidewall of the tire. Shipshe Trailers is not responsible for tire wear, blowouts, or damage due to underinflated tires.
3. You must understand and perform all routine maintenance and operational safety inspections for our products. Proper use and compliance with Federal DOT requirements are also essential.

Warranty Claim Process:

1. Complete the Limited Warranty claim form. (This form was included in your owner’s packet or can be downloaded from the warranty tab at www.shipshetrailers.com.)
2. Email the form and photos of the issue to scott@shipshetrailer.com.
3. A Shipshe Trailers Service Representative will contact you with your claim status and instructions on completing the approved warranty work.

Further Exclusions:

1. Shipshe Trailers assumes no responsibility or liability for defects in workmanship or the operation of separately warranted products. These products may be warranted products by the individual manufacturers, and a copy of their warranties has been included in your owner’s packet. Separately warranted products will not be serviced, repaired, or replaced by Shipshe Trailers. If service or parts are required for these products, refer to the furnished list of factory-authorized service centers.
2. The Limited Warranty does not apply to routine maintenance, such as greasing wheel bearings, tightening lug nuts, keeping areas sealed where extrusions meet panels, or any damage arising from misuse or failure to perform such maintenance.
3. You are responsible for transportation costs to and from Shipshe Trailers or any approved repair facility, including, without limitation, any costs and expenses related to towing that may be required for any Product covered by this Limited Warranty.
4. Shipshe Trailers is not responsible for inconvenience, food, lodging, or damage to personal property, lost income, or earnings.

Limitations of Warranty; Limitation of Liability:

THE EXPRESS WARRANTIES SET FORTH HEREIN SHALL CONSTITUTE THE ONLY WARRANTIES APPLICABLE TO THE PRODUCT(S).  TO THE EXTENT ALLOWED BY LAW, SHIPSHE TRAILERS HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, USE OR APPLICATION, AND ALL OTHER OBLIGATIONS OR LIABILITY ON SHIPSHE TRAILER’S PART, UNLESS SUCH OTHER WARRANTIES, OBLIGATIONS OR LIABILITIES ARE EXPRESSLY AGREED IN WRITING BY SHIPSHE TRAILERS.  TO THE EXTENT THAT LAW PROHIBITS A DISCLAIMER OF ANY SUCH WARRANTIES, SHIPSHE TRAIELRS HEREBY LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THE LIMITED WARRANTY.  SHIPSHE TRAILERS SHALL NOT BE LIABLE IN ANY WAY FOR DAMAGE OR INJURY TO PERSONS OR PROPERTY, OR FOR OTHER LOSS OR INJURY RESULTING FROM ANY CAUSE WHATSOEVER ARISING OUT OF OR RELATED TO THE PRODUCT(S), INCLUDING, WITHOUT LIMITATION, ANY DEFECTS IN THE PRODUCT(S), OR FROM USE OR INSTALLATION.  IN NO EVENT SHALL SHIPSHE TRAILERS BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES,  LOSS OF USE, LOSS OF PROFITS, LOSS OF PRODUCTION, OR LOSS OF REVENUES FOR ANY REASON WHATSOEVER, INCLUDING, WITHOUT LIMITATION, LOST GOODWILL, WORK STOPPAGE, PRODUCT(S) FAILURE, IMPAIRMENT OF OTHER GOODS, INJURY TO PERSONS OR PROPERTY ARISING OUT OF OR RELATED TO THE PRODUCT(S0.  SHIPSHE TRAILERS TOTAL LIABILITY, IF ANY, IN DAMAGES OR OTHERWISE, SHALL NOT EXCEED THE INVOICE VALUE PAID BY YOU FOR THE PRODUCT FURNISHED WHICH IS THE SUBJECT OF CLAIM OR DISPUTE. 

Shipshe Trailers reserves the right to change this Limited Warranty, at its sole and absolute discretion, from time to time; provided, however, any such changes shall not be retroactive.
